General Terms and Conditions

1. scope of application

These General Terms and Conditions (hereinafter “GTC”) govern the legal relationship and the treatment contract between Physiotherapie Glattbrugg GmbH and the patient (hereinafter “the patient”). These GTC apply between Physiotherapie Glattbrugg GmbH and the patient in the form currently valid at the time of treatment. They govern the business relationship for the booked treatment (hereinafter “the treatment”) exclusively, unless otherwise mentioned or agreed.

2. data protection

We collect, process and store personal data in accordance with the applicable data protection regulations in Switzerland. The privacy policy of Physiotherapie Glattbrugg GmbH can be found at www.physioglattbrugg.ch. By making use of the treatment service, the patient agrees to the data protection declarations.

The patient files belong to the patient and will be handed over to the patient at any time on request. They are kept by Physiotherapie Glattbrugg GmbH and made available to the physiotherapists treating the patient and used for billing and collection purposes. For the purpose of invoicing and patient and appointment management, all necessary data will be disclosed to the software manufacturer (PHYSIOSYS AG). We also allow ourselves to exchange medical data and patient data related to the treatment with the referring and treating physicians and medical consultants of the cost bearers and with Swiss insurance companies of all kinds for administrative purposes, and to obtain additional patient data.

3. cancellation conditions

Booked treatment appointments are always binding and the agreed time is reserved for the patient. Missed appointments or appointments canceled too late increase our administrative costs and may not be charged to health or accident insurance. Patients are therefore requested to inform the respective practice in good time, but at least 24 hours in advance, if they are unable to attend.

Physiotherapie Glattbrugg GmbH reserves the right to charge the patient the following treatment costs privately (without entitlement to reimbursement by the health insurance companies) if the appointment is canceled late or not at all and the patient does not show up:

• Physiotherapy: CHF 70.
• Private physiotherapy/massage: according to the booked service

4. payment regulation

Physiotherapie Glattbrugg GmbH invoices medically prescribed services according to the "Tiers payant" system and sends the invoice directly to the health insurance company. This pays the full amount and invoices the patient for any cost sharing. All treatment costs that are not paid by the insurance company/health insurance fund are borne entirely by the patient. It does not matter for what reason the insurance/health insurance company refuses to pay the invoice. In the event of late payment, a fee of CHF 10 will be charged for the first reminder and CHF 20 for the last reminder. After two unsuccessful reminders, the case will be handed over to a debt collection company and an additional CHF 20 will be charged.

The costs for privately billed treatments (private physiotherapy and massage) must be paid by the patient before the next appointment on site or, if no appointment is scheduled, within 30 days of the invoice date.

Payment on site is possible in cash, with the usual debit/credit cards and Postcard.

5. reclaims

It is possible that an insurance company/health insurance fund may demand reimbursement from the patient for treatment costs already paid to Physiotherapy Glattbrugg (Tiers Payant). By agreeing to these GTC, the patient confirms:

• That the patient pays all reimbursements to the insurance company from the invoice of Physiotherapie Glattbrugg GmbH.
• That Physiotherapie Glattbrugg GmbH is not permitted to respond to requests for reimbursement from insurance companies.
• That Physiotherapie Glattbrugg GmbH forwards requests for reimbursement directly to the patient and takes no action in this regard.
• That the patient exempts Physiotherapie Glattbrugg GmbH in any case from having to refund amounts already received, even if Physiotherapie Glattbrugg GmbH AG is forced to refund invoices for legal reasons.
• That the patient is directly responsible for processing the claim and takes care of all related activities such as clarification, processing and settlement.

The aforementioned consents apply to payments from basic insurance, supplementary insurance or privately billed treatments that may have been incorrectly billed to the health insurance company.

Even in the case of reclaims, all treatment costs that are reclaimed by an insurer/health insurance fund are borne in full by the patient, regardless of the reason for the reclaim.

6. refusal of payment by health insurance companies

Insurance companies/health insurance funds may refuse to pay the treatment costs. The patient is committed to protecting himself as best he can against refusals of payment or reclaims. The following measures will help:

• If the patient is unsure whether the therapy, medical training therapy etc. will be paid for, the patient should ask the doctor for a cost approval from the health insurance company.
• The patient checks all invoices and informs Physiotherapie Glattbrugg GmbH of any discrepancies.

7. treatment

The treatment of the patient is based on the generally recognized and known standards and rules of modern physiotherapy and medical massage. As is generally in the nature of therapeutic and medical treatment, a specific treatment success cannot be guaranteed.

8 Place of jurisdiction and applicable law

The place of jurisdiction for disputes arising from or in connection with this contract is Opfikon, Switzerland. Applicable law is exclusively Swiss law, excluding the conflict of laws.

9. final provisions

Physiotherapie Glattbrugg GmbH reserves the right to amend these GTC at any time. The currently valid version is available on our website at www.physioglattbrugg.ch. The amended version shall enter into force upon publication on the website.

Should provisions of these General Terms and Conditions be invalid or unenforceable, this shall not affect the validity of the remaining provisions. The invalid provisions, if any, shall be replaced by the statutory provisions.
